ИСКУССТВЕННЫЙ ИНТЕЛЛЕКТ И «ЮРИДИЧЕСКОЕ ВЫРАВНИВАНИЕ» В АРБИТРАЖНОЙ ЮРИСДИКЦИИ

ARTIFICIAL INTELLIGENCE AND "LEGAL ALIGNMENT" IN ARBITRATION JURISDICTION ABSTRACT The article focuses on the development of the concept of "legal alignment" of artificial intelligence systems in relation to arbitration jurisdiction. In the context of the active digital transformation of justice, AI is penetrating deeper into the activities of public authorities, internal judicial procedures, and enforcement proceedings. This creates risks of undermining the fundamental principles of the arbitration process, such as the independence of judges, competitiveness, equality of the parties, and the reasonableness of judicial acts. Based on his analysis of global risk-based, hybrid, technocratic models of legal regulation of AI and V. A. Vaipan's concept of a special federal law on AI, the author formulates three essential principles of legal alignment: AI auxiliarity (AI does not have the right to substitute judicial discretion), transparency and challengeability of algorithms (algorithmic decisions must be explainable and accessible for judicial review), and responsibility with risk sharing (the public authority is responsible to the addressees of the decisions, while the developer is responsible for the system's quality). The concept is illustrated by three model situations from arbitration practice: challenging an automated denial of a public service, a dispute over the prioritization of enforcement cases, and the use of AI in preparing a judicial act. It is concluded that it is necessary to adopt a special federal law on AI, combining a risk-based approach in socially significant areas with a pro-innovation policy, and a special federal law on the institution of sovereign Russian AI models and the human right to refuse interaction with an AI agent.
