THE RIGHT TO CHALLENGE AN EXPERT: REGULATORY, PROCEDURAL AND ENFORCEMENT ASPECTS

ABSTRACT
The right to disqualify an expert as a procedural institution is the cornerstone of ensuring the mandatory conditions that a forensic expert must meet-competence and independence. Modern forensic practice demonstrates that these two criteria determine the quality of an expert's report as a source of evidentiary information. However, despite the apparent procedural certainty and transparency, exercising the right to disqualify remains a highly problematic aspect of law enforcement.
This article, based on an analysis of current legislation and forensic practice, examines issues related to the exercise of the right to disqualify a forensic expert, including its conflicts of laws.
